King’s son brings message to South Florida

The past few days have kept the eldest son of Dr. Martin Luther King Jr. busy. He’s been to at least three states to carry on his father’s message: ending violence and learning from historical wrongs.

In a Fort Lauderdale Baptist church early Friday, he delivered another directive:

“A nation is judged on how we treat our most prized possession,” Martin Luther King III said. “And our most precious resource, I think, is our children.”

King served as the keynote speaker at the ninth annual Martin Luther King Jr. inspirational breakfast hosted by the YMCA of Broward County.

More than 500 gathered inside the First Baptist Church on Broward Boulevard, selling out the $2,500 per table event, to honor King’s legacy.

“My concern was that it would not be reduced to a day of relaxation,” said King III. “We have to look at this as a day on — not a day off.”

The Rev. King, a prominent civil rights leader, was born this week 84 years ago. He lead peaceful protests and bus strikes working for racial equality until his 1968 assassination.

The younger King told the South Florida audience about spending his youth at the local YMCA in Birmingham, learning to swim and working out with his dad.

“Those were wonderful experiences, experiences that I will never forget,” he said.

Like his father, King III has been a fighter for human rights, justice and non-violence in the United States and abroad. He also served as the Southern Christian Leadership Conference’s president, a position his father once held.

During his 2009 inauguration, President Barack Obama declared the holiday honoring King should be spent as a national day of service.

At Friday’s event, 15 youngsters from the Lauderhill YMCA were honored for their service to the community. The young friends managed to clean up a popular overpass and get rid of gangs who were harassing children.

They called their project “Own the Overpath.” The idea started when 14-year-old Kervens Jean-Louis was attacked by a gang on a fenced in walkway that spans the Florida Turnpike while coming from the YMCA, based at Boyd Anderson High School. But Jean-Louis didn’t back down.

He and other students mobilized and launched a campaign to clean-up the area surrounding the “overpath.” The youngsters made a formal presentation to the Lauderhill City Commission and Florida Department of Transportation officials.

Now, there is a $400,000 project in the works to install more lights on the bridge to increase visibility. The city broke ground in November.

“I learned that when you speak out loud it makes a difference,” said Jean-Louis.

For Jean-Louis, speaking loud meant going back to the bridge to warn others of the dangers of traveling across it at night.

He will spend this upcoming Saturday as a volunteer, painting and cleaning up a garden.

“Now I tell others what’s going on and how they can help out,” he said, much like the man they had all come to honor.

After the youngsters were honored, King III left the crowd to ponder a final thought: “We can either be a thermometer or a thermostat.”

A thermometer, he explained, takes the temperature while a thermostat regulates the temperature.

Despite the progress his father saw in his lifetime, and the decades since his death, there is still much work to be done, King III said.

“I always come with a heavy heart in January,” he said. “Because we have not fully realized the dream.”

Arrest made in death of Amityville boy, 4

Frank Eltman

Police investigate the death of an Amityville child's death.

AMITYVILLE — An arrest has been made in the slaying of a 4-year-old boy found alone inside a Long Island apartment after an anonymous 911 call, police said Saturday.

Jonathan Thompson, 31, was charged with second-degree murder in the death of Adonis Reed, Suffolk County police said in a news release.

Adonis was found unconscious on a couch in an apartment in a private house on a quiet Amityville street on Wednesday afternoon. He was pronounced dead at a hospital, and his death was classified as a homicide. Detectives said he showed signs of being assaulted.

Suffolk County police Lt. Jack Fitzpatrick told reporters Wednesday night that Adonis was "a victim of violence."

Thompson's home address is the same as the residence where the boy was found. He was arrested in Brooklyn with the help of the U.S. Marshals Service.

Thompson was in custody Saturday and not immediately available for comment. He is scheduled to be arraigned later in the day.

Neighbor Eric Erath told reporters on Thursday that he used to see the little boy and his 6-year-old sister occasionally playing around the house, but he couldn't recall the last time. "Every time I used to see them, they were both very cheerful," said Erath, who lives next door.

He said he never saw any signs of abuse. "I do not believe anything like that happened," he said.

The boy's sister was in the custody of county child welfare officials, police said. It wasn't clear if the children lived at the apartment.

The apartment house where the boy's body was found is in a middle-class neighborhood with a hodgepodge of old and new architecture. The apartment is in a two-story Victorian-style house with yellow shingles.

Miami-Dade sees first hiring drop since 2010

Miami-Dade ended 2012 with its first overall job loss in more than two years as sharp drops in construction, healthcare and government jobs wiped out other gains.

The sectors all share one key funding source — tax dollars — as ongoing squeezes in government budgets force cutbacks in hospitals, infrastructure projects and basic municipal staffing. Miami-Dade lost nearly 5,000 local government jobs in December compared to the year before. Its hospital and construction sectors were both down almost 2,000 jobs each. Miami-Dade last saw its overall payroll number decline in June 2010.

Along with a hiring loss, Miami-Dade reported a sharp increase in people describing themselves as unemployed. Miami-Dade’s unemployment rate went from 8.4 percent in November to 8.8 percent in December, the sharpest increase since the recession was still underway in 2009.

Miami-Dade’s new job numbers were easily the most discouraging data set in Florida’s latest employment report. Florida reported an unemployment rate of 8 percent for December, down from 8.1 percent in November even though hiring is down for the year. And Broward recorded its second month of job gains, up about 5,000 positions.

Construction and government hiring have been rocky for years in South Florida, but the decline in the healthcare could mark a new, disturbing milestone for Miami-Dade’s economy. Before the end of 2012, Miami-Dade hospitals hadn’t reported a net job loss for 56 months. The losses follow significant layoffs at both the University of Miami medical school and the Jackson hospital system.

Miami-Dade’s 8.8 percent unemployment rate is still significantly lower than where it was a year ago, when unemployment sat at 10.2 percent in December 2011. Monthly employment reports also subject to revisions, so the hiring picture could look much better in a month. Still, Miami-Dade’s increase of four-tenths of percentage point in the unemployment rate is the fastest growth since April 2009, two months before the 2007-09 recession officially ended.

Of all the local job markets, only Miami-Dade receives a seasonally adjusted unemployment rate on the same day as the statewide report. The smaller markets’ raw rates aren’t considered as reliable.

Broward’s raw unemployment rate was 6.7 percent in December, down from 7 percent in November.

Mo. lawmaker wants tax on violent video games

JEFFERSON CITY, Mo. (AP) — A Republican lawmaker from rural Missouri bucked her party’s anti-tax bent on Tuesday and called for a sales tax on violent video games in response to a deadly Connecticut school shooting.

Rep. Diane Franklin, of Camdenton, said the proposed 1 percent sales tax would help pay for mental health programs and law enforcement measures aimed at preventing mass shootings. The tax would be levied on video games rated “teen,” ”mature” and “adult-only” by the Entertainment Software Rating Board, the organization in charge of rating video games.

The rating board classifies games as “teen” if they contain violence, suggestive themes and crude humor. The popular music game “Guitar Hero” has a teen rating and would be taxed under Franklin’s plan. Another popular title, “Call of Duty,” has a mature rating and also would be subject to the sales tax. “Mature” games are deemed suitable for people 17 and older and may contain intense violence and gore.

“History shows there is a mental health component to these shootings,” Franklin said, referring to the Sandy Hook Elementary School shooting that killed 20 students and six adults in Newtown, Conn., and the Aurora, Colo., movie theater shooting that left 14 dead.

Franklin’s plan is the latest in a string of measures proposed in response to recent mass shootings. Another Missouri Republican has filed a measure that would allow teachers to carry guns in the classroom. On the national level, Vice President Joe Biden is leading an effort to reduce gun violence and is expected to reveal recommendations Wednesday that include steps to improve school safety and mental health care, as well as address violence in entertainment and video games.

Franklin’s proposal already faces opposition from the Entertainment Software Association, which represents companies that publish computer and video games.

“Taxing First Amendment protected speech based on its content is not only wrong, but will end up costing Missouri taxpayers,” the association said in a written statement.

Tax increases typically are a hard sell in Missouri. This past November, voters rejected a proposed tobacco tax increase for the third time in a decade, choosing instead to leave the state’s cigarette tax at the lowest level in the nation. Republican legislative leaders and Democratic Gov. Jay Nixon both have taken stands against tax increases.

Other proposals to tax violent video games failed in Oklahoma in 2012 and New Mexico in 2008. In Oklahoma, Republican state Rep. William Fourkiller had proposed a violent video games tax to combat childhood obesity and school bullying, but his plan failed to make it out of a committee.

Other non-tax efforts to curb the effect of violent video games also have fallen short. U.S. Sen. Jay Rockefeller, D-W. Va., put forward a measure last year for the study of the impact of violent video games on children, but it failed. A California law banning the sale of violent games to minors was struck down by the U.S. Supreme Court in 2011.

The Entertainment Merchant’s Association sent a letter to Biden last week urging him to look elsewhere when it comes to his plans on gun violence.

“Make no mistake: blaming movies and video games is an attempt to distract the attention of the public and the media from meaningful action that will keep our children safer,” wrote the merchant’s association, a lobbying group for the home entertainment industry.

Others, however, have criticized the video game industry and its role in mass shootings.

“There exists in this country a callous, corrupt and corrupting shadow industry that sells, and sows, violence against its own people,” National Rifle Association Executive Vice President Wayne LaPierre said at a December news conference.

Franklin said she hopes her bill will “start a discussion” on the relationship between violent games and mental illness. Franklin, who has a granddaughter in kindergarten, added she is concerned about the safety of schools and universities in the state.

In 2008, there were 298 million video games sold in the U.S., generating $ 11.7 billion in revenue. Six of the 10 best-selling games included violence, and four carried a “mature” rating.

Franklin’s bill was formally introduced Monday and must be referred and approved by a committee before being considered on the House floor.

Catfish Creator Talks Manti Teo and Kekua

The story of Notre Dame All-American linebacker Manti Te'o, and the hoax he reportedly perpetuated, has captivated both sports-lovers and novices alike. In short, Te'o had started an online relationship with a woman who used the phony name Lennay Kekua, and fooled the athlete into believing she died of leukemia in September. Te'o was vocal about Kekua's battle, further endearing him to the Football nation.

But on Wednesday, Te'o's story was exposed as a lie in the press, 10 days after he reportedly learned of the hoax himself. The rub is that, despite learning that Kekua was a fraud on December 6, he continued to talk about her battle with leukemia in interviews on December 8 and again in a newspaper interview published Dec. 10, according to The Huffington Post.

Putting aside Te'o's potential perpetuation of this hoax for personal gain (some have posited he did so to further endear himself to Heisman Trophy judges), this phenomenon is not only becoming increasingly more commonplace, but it's a full-fledged TV phenomenon thanks to MTV's Catfish, based on the 2010 documentary.

Nev Schulman, the original "Catfish," Tweeted on January 16, "I am working on finding out more about this @MTeo_5 #Catfish story. I have been in contact with the woman involved and will get the truth." He later Tweeted at Manti, saying, "I know how you feel. It happened 2 me. I want 2 help tell ur story & prevent this from happening to others in the future. Lets talk."

Nev's brother, and Catfish co-producer, Ariel Schulman appeared on Good Morning America minutes ago and revealed that while Manti hasn't returned their interview requests, they have learned quite a bit about what happened behind the scenes.

"[Nev and Catfish co-host Max Joseph have] uncovered a few people who were duped by the fake Kekua character," Ariel told George Stephanopoulos. "It's bigger than Manti, there were other people she was corresponding with."

When asked why Te'o would carry on a relationship with someone he'd never met, Schulman explained, "I think when you want something bad enough, in his case, a connection, you'll ignore the red flags. My gut is that there's a lonely person behind it all who didn't expect it to go this far. My guess is there was no malicious intent and it was just two people looking for love."

Japan probe suspects excess voltage in Boeing 787 battery

TOKYO — The burned insides of a battery in the Boeing 787 at the center of a worldwide grounding of the aircraft indicate it operated at a voltage above its design limit, a Japanese investigator said Friday, as US officials joined Japan's probe into the incident.

The All Nippon Airways plane made an emergency landing Wednesday morning in western Japan after its pilots smelled something burning and received a cockpit warning of battery problems. Nearly all 50 of the 787s in use around the world have since been grounded.

Photos provided by the Japan Transport Safety Board of the lithium ion battery that was located beneath the 787's cockpit show a blackened mass of wires and other components within a distorted blue casing.

AP

The distorted main lithium-ion battery of the All Nippon Airways' Boeing 787, which made an emergency landing on Wednesday at Takamatsu airport in Japan.

Japan transport ministry investigator Hideyo Kosugi said the state of the battery indicated "voltage exceeding the design limit was applied" to it.

He said the similarity of the burned insides of the battery from the ANA flight to the battery in a Japan Airlines 787 that caught fire Jan. 7 while the jet was parked at Boston's Logan International Airport suggested a common cause.

"If we compare data from the latest case here and that in the U.S., we can pretty much figure out what happened," Kosugi said.

The 787 relies more than any other modern airliner on electrical signals to help power nearly everything the plane does. It's also the first Boeing plane to use rechargeable lithium-ion batteries for its main electrical system. Such batteries are prone to overheating and have additional safeguards installed that are meant to control the problem and prevent fires.

GS Yuasa Corp., the maker of the lithium-ion batteries used in the 787s, said Thursday it was helping with the investigation but that the cause of the problem was unclear. It said the problem could be the battery, the power source or the electronics system.

U.S. safety officials and Boeing inspectors joined the Japan Transport Safety Board investigation Friday.

The American investigators — one each from the Federal Aviation Administration and the National Transportation Safety Board and two from Boeing Co. — inspected the ANA jet on the tarmac at Takamatsu airport in western Japan.

An initial inspection by Japanese officials of the 787 found that a flammable battery fluid known as electrolyte had leaked from the plane's main lithium-ion battery beneath the cockpit. It also found burn marks around the battery.

Aviation authorities in Japan have directed ANA, which owns 17 of the planes, and Japan Airlines, with seven, not to fly the jets until questions over their safety have been resolved.

The 787, known as the Dreamliner, is Boeing's newest jet, and the company is counting heavily on its success. Since its launch after delays of more than three years, the plane has been plagued by a series of problems.

The FAA has required U.S. carriers to stop flying 787s until the batteries are demonstrated to be safe. United Airlines has six of the jets and is the only U.S. carrier flying the model.

Aviation authorities in other countries usually follow the lead of the country where the manufacturer is based.

Prices for Miami Beach luxury condos soar to records

Ultra-luxury condominiums on South Beach are fetching nosebleed prices.

On Tuesday, a penthouse at the Setai Resort at 2001 Collins Avenue closed for $27 million — the highest price ever for a South Florida condominium, according to real estate agents.

“We’re definitely seeing the market turning upward,” said Jeff Miller, of Zilbert International Realty in Miami, who represented the buyer in the sale of the palatial 7,100-square-foot condominium. “We’re seeing buyers come in from all over the globe.”

Just a few weeks ago, Ohio coal mining businessman Wayne Boich Jr. completed the sale of his Icon South Beach penthouse at 450 Alton Road in the uber-trendy South of Fifth neighborhood for just under $21 million.

The 6-bedroom, 7 1/2-bath Icon condo sparked a bidding war that drove the sale $2 million above the listing price — a level that is three times the $7 million Boich paid in July 2007 in the depths of the bust. It was a record price for a Miami Beach bayside condo.

“The luxury market is on fire in South Beach — especially the South of Fifth neighborhood,” said Dora Puig, principal of PuigWerner Real Estate Services, who was the listing broker for the Icon unit. “It’s moving Miami to totally different pricing points.”

The Setai’s record may not reign for long.

Penthouse 2 in the decade-old Continuum South tower at 100 South Pointe Drive in the South of Fifth neighborhood is on the market for $39 million.

That is a record listing price for a Miami-Dade condominium, according to Puig, who also snagged that listing.

Amid the market sizzle, Puig bumped up the asking price late last summer from $35 million.

The penthouse, which has 11,000 square feet of interior space, belongs to Manhattan real estate developer Ian Bruce Eichner, who built the Continuum project at the tip of South Beach and kept the trophy for himself.

The Continuum penthouse, which has 6,000 square feet of deck and a rooftop heated pool, boasts sweeping 13 1/2-foot ceilings that give the feel of a single-family home. The floor-to-ceiling glass walls offer a 360-degree view of the Atlantic Ocean, Biscayne Bay, downtown Miami and Miami Beach from 40 stories up.

“It looks down on Fisher Island, way down,” Puig said with a smile.

The unit has a private interior elevator, of course, and stretches over two indoor levels and two largely exterior levels.

One big plus: It has a gated entrance and sits on an expansive enclave of rolling lawns and gardens adjacent to a city park at the tip of the island.

The unit comes with an additional 874-square-foot guest quarters that would delight most mortals. “The guest unit is intended for professional quarters: the maid, the nanny, the chef, the pilot,” Puig explained.

Also included is a snazzy cabana on the beach.

Eichner has used it as a vacation home and once rented it to Tom Cruise for a couple of months while he was in Miami to film Rock of Ages.

On Thursday, Puig hosted Miami’s power brokers for a look at the Continuum penthouse over champagne and hors d’oeuvres. Next week, she plans to spend three days in New York touting the property to high-end brokers.

Such palatial properties typically are paid for in cash. But what would a monthly payment be?

With a 20 percent down payment of $7.8 million, the buyer would have to finance $31.2 million.

“I don’t know that I’d be able to find anybody willing to go that high on one unit,” warned Steve Schneider, a mortgage broker who is owner and president of Abacus Lending Group in South Miami.

If a buyer could line up a 15-year fixed rate mortgage at 3.5 percent, the monthly payment for principal and interest would be $223,043.35.

“I’d hate to see the tax bill,” said Schneider.

According to Miami-Dade County Property Appraiser records, the 2012 property tax bill on the Continuum penthouse was $264,896.17. That was based on an assessed value of just $9.5 million, less than half what the Property Appraiser listed as the market value of $19.3 million. The tax break came as a result of the state law that caps increases in assessed values on non-homesteaded property at 10 percent a year.

The condo maintenance fee for Eichner’s unit runs $7,624 a month. “I think that’s low for what you get,” said Puig.

Weather alert: Cold front moving in today; lows dipping into the 50s at night

After the sun goes down Thursday night, open the windows.

Forecasters say South Florida will cool down overnight to the mid-50s. The heat relief will be spiced with a breeze.

According to the National Weather Service, Friday’s daytime temperatures will snap up to the low-70s before cooling down again at night to the low-60s.

“We may have a hard time getting to 70 degrees on Friday,” said David Bernard, chief meteorologist at Miami Herald new partner CBS4. That he said, will be a “shock to the system” for South Floridians basking in winter warmth so far.

Bernard says the cold front will move in Thursday afternoon, preceded by rain.

Through the weekend, highs will be in the high-70s, with lows in the mid-60s.

Missouri Lawmaker Wants Violent Video Games Taxed

A rural Missouri lawmaker wants her state to tax certain video games to help curb gun violence. The Associated Press reports state Rep. Diane Franklin, R-Camdenton, believes a 1 percent sales tax on video games rated teen, mature and adults only would help finance mental health programs aimed at reducing gun violence such as the recent mass shooting at Sandy Hook Elementary School in Newtown, Conn.

What does the legislation propose?

House Bill 157 proposes to create “an excise tax based on the gross receipts or gross proceeds of each sale” of video games rated by the Entertainment Software Rating Board (ESRB). The tax also involves the “storage, use or other consumption” of violent video games in Missouri including “tangible personal property.” This means the tax could extend to memorabilia derived from the games such as toys, clothing and video game accessories.

How does the legislation hope to enhance public safety?

The law hopes to procure “new and additional funding for treatment of mental health conditions associated with exposure to violent video games… .” The revenue from the tax cannot be used to replace existing revenue already in place. Franklin deems the legislation “necessary for the immediate preservation of the public health, welfare, peace and safety.” Therefore, if the legislation passes it will go into effect immediately. There is no mention in the legislation as to how much revenue should be generated, nor does it say whether the sales tax is just on new merchandise as opposed to used games on the secondary market.

Have similar laws been considered before?

A similar proposal was struck down in mid-February in Oklahoma. Democrat William Fourkiller crafted legislation in 2012 that is very similar to Franklin’s idea in Missouri. A subcommittee struck down the bill by a 6-5 margin. Fourkiller, in defending the law , said it wasn’t a “magic bullet” but that Oklahoma had “to start somewhere” to curb childhood violence. Oklahoma also would have taxed ESRB teen, mature and adults only games at a rate of 1 percent.

Does the Missouri law have a chance to pass?

CNN notes a federal appeals court made a ruling in 2003 that video games are free speech protected by the First Amendment. Ironically, it was a federal case stemming from St. Louis County, Mo., that created the precedent for video games as free speech. Senior U.S. District Judge Stephen Limbaugh’s decision was reversed by an appellate panel. The ruling came shortly after the state of Washington banned the sale of certain video games to children under the age of 17. Gamasutra reveals New Mexico also tried, and failed, to pass a similar law in 2008.

What are Franklin’s credentials as they relate to the proposed bill?

Franklin was first elected in 2010 from Camdenton. She is a mother of two sons and served on Camdenton School Board from 1993 to 1999. She sits on the House Appropriations-Education committee. Franklin is a third-generation small business owner and comes from a farming family. Missouri Republicans currently have a veto-proof supermajority in the General Assembly. Camdenton is a small city of around 3,700 people near Lake of the Ozarks in central Missouri.

William Browning is a research librarian specializing in U.S. politics.

SAG Awards Flashback: Javier Bardem 2008

Javier Bardem made an immediate impact on the film world when he began undertaking roles in wide-release American films; however, he didn't experience the reward of his American film success until undertaking ruthless hit-man "Anton Chigurh" in No Country for Old Men.

The Spanish actor had received plenty of accolades in his native country but had yet to receive any tangible reward for his American films until 2008. He had been nominated for an Oscar and a Golden Globe for his first American film, Before Night Falls, but still had nothing to solidify his touted performances.

VIDEO: Javier Bardem is an 'Uncomfortable' Bond Villain

"It's a great honor of course, and I guess what I did is to take it and say, 'O.K., thank you for that; it's a great honor," he says to ET's former co-host Mary Hart at the 2008 SAG Awards of his many nominations for No Country. "There's not much you can do other than really thank the people that thought that you could be included in [the nominees category]."

Bardem would have plenty more thanking to do that night, as he won not only the Best Supporting Actor Award but also received the Best Cast Award for No Country. A few weeks later, he completed his sweep of the awards circuit with an Oscar for the role.

"I'm so happy!" Bardem offers in Spanish when prompted by Mrs. Hart to celebrate as he would in his native tongue.

While Bardem won't have the opportunity to make an awards sweep as he did in 2008, the 43-year-old actor has been given another SAG nomination to be thankful this year, this time for his supporting role in Skyfall.

Bloomberg calls NRA ad 'dumb PR'

New York City Mayor Michael Bloomberg says a new NRA Web video that labels President Barack Obama an "elitist hypocrite" is "dumb PR."

In an appearance Thursday on "CBS This Morning," the mayor said: "You have to be stupid to do that."

The video's narrator asks why Obama is skeptical of putting armed security in schools when his daughters are protected by armed guards in their own school.

The White House has called the NRA ad "repugnant and cowardly."

Bloomberg, who's a strong gun control advocate, said the NRA was itself hypocritical for coming out with a video shooting game app.

After the Newtown, Conn., tragedy, the NRA blamed violent video games and movies, not guns, for contributing to mass shootings.

Jackson Health System asks Kendall trauma center be shut down

Ratcheting up the stakes in Miami-Dade’s hospital wars, Jackson Health System has filed two petitions with the state demanding a hearing to consider its belief that the license for trauma operations at Kendall Regional Medical Center was granted illegally and should be revoked.

Jackson, which for years has had the county’s only trauma center, has been complaining loudly since the Scott administration decided the state needed more centers. Kendall Regional’s opened in November 2011.

Jackson executives estimate it has been losing about $28 million a year since then because, as one of its trauma doctors quipped, Jackson Memorial’s Ryder Trauma Center tends to get the inner-city gunshot victims who have no insurance while Kendall gets the suburban car accident victims with insurance.

State officials and the HCA hospital chain, which owns Kendall Regional, maintain that Miami-Dade’s size requires more than one trauma center.

Mark McKenney, medical director of the Kendall center, said Wednesday the center has treated 2,500 patients in its first year -- “with mortality rates significantly below the state and national averages.” He said Kendall treats anyone who comes through the door, including plenty of gunshot and stabbing victims who may or may not have insurance.

McKenney said the state decided Miami-Dade needed more trauma centers after a 2005 study showed that only 39 percent of the county’s trauma victims were treated in trauma centers. Those treated in ordinary emergency rooms showed a considerably higher mortality rate, McKenney said.

In Miami-Dade, HCA’s Mercy and Tenet’s Palmetto General have also applied for trauma licenses. Jackson countered by seeking trauma units at its two community hospitals, Jackson North and Jackson South.

In its filings to the Department of Health on Jan. 2, Jackson’s lawyers asked for formal administrative hearings, maintaining North and South were unfairly denied approval in a Dec. 13 Department of Health letter that stated the regulators were rethinking trauma rules on trauma centers after court rulings.

The Jackson petitions, first reported on Tuesday by Jim Saunders of News Service of Florida, noted that an administrative law judge in November 2011 decided that the Department of Health’s trauma certification rule was invalid. After that, the department granted provisional licenses to Kendall Regional and three other hospitals.

On Nov. 30, 2012, the First District Court of Appeal upheld that decision. Seven days later, the department approved the application of Ocala Regional, another HCA facility, and allowed it to open the following day. Gov. Rick Scott is the former chief executive of HCA.

Jackson’s attorneys accused the department of giving these other hospitals a “selective benefit.” They said that a hearing would establish that “the ultimate facts” show that “all provisional licenses issued under the invalid trauma rule need rule should be revoked,” as well as all pending applications, until the department established a legally acceptable rule on trauma centers.

Steve Ecenia, an attorney for HCA, called Jackson’s petition “bizarre” because, instead of seeking approval for its own applications, it was trying to hit back at other hospitals, including Ocala, “hundreds of miles away.” He said the appeals court decision wasn’t final, because there are demands for a rehearing, and the Department of Health’s licensing has been fair.

A Department of Health spokeswoman said Wednesday that the department “had no additional information to provide.” A Jackson spokesman said executives couldn’t comment “because of pending litigation.”

Wayne Brackin, chief operating officer of Baptist Health South Florida, said Baptist is “very worried about this trauma issue,” because in the 1980s, the trauma system fell apart in Miami-Dade with many hospitals losing money on the service, and Baptist doesn’t want the Ryder Trauma Center weakened by competition that could again endanger trauma care in the county.

Closing arguments on tap today in Miami police sergeant’s drug-corruption trial

A brawling federal trial in which a Miami police sergeant has fought against accusations by fellow officers that he’s corrupt will wrap up Wednesday with closing arguments followed by jury deliberations.

Miami police Sgt. Raul Iglesias, who ran a drug-fighting squad, testified earlier this week that a string of government witnesses — including four detectives from his unit — all lied while accusing him of planting dope on a suspect and stealing drugs and money from street dealers.

Iglesias, 40, former commander of the Crime Suppression Unit, denied again and again that he ever did anything illegal on the job, including asking detectives for “throw-down dope” to plant on the suspect in a downtown Miami parking lot in early 2010.

“Absolutely not,” Iglesias testified, disputing the recent testimony of two detectives. “That’s a ridiculous statement,” he said, calling his former colleagues “liars.’’

Iglesias further testified he never told a third detective that it was OK to pay confidential informants with drugs.

The detective, Roberto Asanza, testified he did just that in May 2010, with Iglesias sitting by his side.

But Iglesias denied the confidential informant was paid with a small baggie of cocaine after a bust in the Allapattah area. Asanza, after pleading guilty to a misdemeanor possession charge, received a probationary sentence last year.

“I have no knowledge that he ever paid [the informant] with drugs,’’ Iglesias testified.

Iglesias, who faces nine counts of conspiracy to possess cocaine, violating suspects’ civil rights, obstruction of justice and making false statements, seemed unflappable as his defense attorney, Rick Diaz, questioned him Monday. Iglesias was relieved of duty with pay in May 2010.

But on cross examination, federal prosecutor Ricardo Del Toro mocked the 18-year veteran officer’s testimony, saying that if he is to be believed, that means five government witnesses lied and he is the only one telling the truth.

“That’s No. 5,” Del Toro declared in astonishment at one point, as Iglesias accused one more witness of lying about his alleged wrongdoing.

Earlier in the trial, CSU detectives Suberto Hernandez and Luis Valdes told jurors that Iglesias asked the pair if they had any “throw-down dope” to plant on a drug suspect after a search of the man during a Jan. 27, 2010, surveillance operation turned up no drugs.

“He looked at myself and Hernandez and he asked for throw-down dope,” said Valdes, an officer for nearly nine years.

“I said, ‘We don’t do that here. Nobody on this team does it.’’’

iPhone demand said to be ‘robust,’ recent cuts don’t reflect weak demand

Following recent reports from Nikkei and The Wall Street Journal that suggested Apple (AAPL) slashed iPhone 5 component orders in half due to weak demand,  the company’s stock fell significantly and opened below $ 500 for the first time in nearly a year. The reports have been called into question, however, with many believing they do not represent true consumer interest. Shaw Wu of Sterne Agee wrote in a note to investors on Tuesday, per Apple Insider, that his supply chain checks have indicated that demand for the iPhone 5 “remains robust.” The analyst believes the recent reports are a result of improved yield rates and possibly Apple’s recent supplier changes.

[More from BGR: PlayStation 4 and Xbox 720 could cost just $ 350, expected to launch this fall]

Despite the recent concerns, Wu expects Apple to post better-than-expected earnings for the December quarter led by sales of 47.5 million iPhones with a gross margin of 38.7%. Both estimates are above Wall Street’s expectations of between 46 to 47 million iPhones and a 38.3% gross margin.

[More from BGR: HTC One SV review]

Sterne Agee reiterated its Buy rating on shares of Apple with a price target of $ 840.

Wu’s expectations remain bullish compared to other Wall Street analysts. Stuart Jeffrey of Nomura is the most recent analyst to cut his outlook on Apple stock. Nomura reduced the company’s price target to $ 530 from $ 660 Tuesday morning, citing weak demand for the iPhone 5 and increased pressure on Apple’s margins.

'Cougar Town' Cast on Switching to TBS for Season 4

After premiering on ABC, Cougar Town has moved to TBS after three seasons, making the switch from network television to cable. With the show now in its fourth season, the cast revealed what they think of the channel switch.

"'Those are some smart people!'" star Courtney Cox emulated her response to TBS picking up the show. "I was just like, 'Great. It's someone who'll promote the show and it'll be something they're proud of.' It just felt great."

The cast echoed Cox's feelings on the move to TBS, citing their new network's heavy promotion of its shows as a big perk. Busy Phillips summed up the cast's perception of the move as a confidence boost to the show.

VIDEO: 'Cougar Town' Cast on the Prowl in Vegas

"Anytime you're given a second chance as a television show, it's awesome," she said. "With TBS, it's been such an awesome opportunity 'cause here's a network that...has this great brand that they're promoting...Of course it's been great to move from a place where we didn't feel like we were getting a lot of attention or promotion or network love to a network that's very enthusiastic."

Phillips, who plays Courtney Cox's character's assistant, "Laurie Keller," maintains that not only does the new network give Cougar Town a new platform but also gives it an opportunity to properly establish its identity.

"People will get a chance to see that it's not a show about...Courtney Cox sleeping with young guys. It's not about cougars; it has nothing to do with cougars," she said. "It's about this amazing, weird, funny group of friends and family that drink a lot of wine and have a lot of silly games that they like to play."

PICS: A Marriage in Pics: Courteney Cox and David Arquette

With the switch from network to cable comes more leeway with censorship, which presents the already racy show with an opportunity to become even racier. Cox, who is also a co-executive producer on the show, said she can already feel the difference.

"I think already our show is the same, yet I feel like it's a little racier," she said. "It's a little more out-and-out funny."

Watch the full video to see how Cox's young daughter, Coco, reacts to hearing her mom recount a naked shoot in front of the entire cast and crew.

Cougar Town
airs Tuesdays at 10 p.m. on TBS.

Mayor: City won't back down on bus union's job demands as thousands of kids, parents left stranded

Getty Images

Thousands of city kids were left stranded this morning when school-bus drivers and matrons went on strike, leaving parents scrambling to find other ways to get their childen to school.

On Fox-5 TV this morning, the mayor said the city won't back down.

"There's no extra money so we couldn't change our mind and cave if we wanted to," Bloomberg said. "There's only a certain amount of money. I'm not going to move money away from police and worry about safety in the streets to pay bus drivers."

The mayor also said he would not ask the courts to intervene right now.

"I don't think it's time yet to do that. No. 1, it's not clear that all of the unions are striking. We'll find out later this morning. It's not clear this union won't come to its senses and say I just don't want to hurt the kids -- and this is not something that's going to help them. They're going to lose out on their pay from now until June," said the mayor.

The schools chancellor predicted widespread problems.

"It's going to be chaotic today, it's going to be traumatic. This is the first day. It hasn't happened in 33 years," said Walcott.

The devastating job action, called Monday by the union representing most of the city’s yellow bus drivers and matrons, left as many as 152,000 children — including 54,000 special-needs kids — faced with travel nightmares or even getting stuck at home for the duration of the work stoppage.

City officials took to the airwaves yesterday to blast Local 1181 of the Amalgamated Transit Union for leaving the students — many of whom have already suffered through Hurricane Sandy and missed a week of school — in the lurch.

“The union drivers are striking against our children, plain and simple,” Walcott said yesterday.

The city distributed free MetroCards to tens of thousands of students yesterday to help them with the expected transportation chaos. Free monthly cards also will be handed out to parents of kids in second grade and younger today.

But MTA officials acknowledged that the cards might not work at all subway stations until later today, nor on all public bus routes until late tomorrow.

The last time city school-bus drivers went on strike was 34 years ago. It lasted three months.

Today’s strike was sparked over a job-protection clause that the city removed from newly bid-out contracts.

Local 1181 claims that up to 2,500 of its members’ jobs will be at stake if new bus companies are awarded contracts in June without the protective clause.

“We’ve tried every option to avoid a strike, but our members feel that their back is to the wall and they must take a stand on this issue,” said Local 1181 chief Michael Cordiello.

Workers were heard chanting this morning "What do we want? Contracts. When do we want them? Now."

The city disputes the group's job numbers and insists it wasn’t allowed to maintain the protections because they were deemed illegal by the state’s highest court in 2011.

Education officials also said they’re trying to trim costs from their $1.1 billion yellow-busing budget, the highest in the nation.

While at least six small bus companies said they were planning to operate as usual this morning, it wasn’t clear whether union protesters might try to block them.

Asked yesterday whether his union would allow other workers to cross picket lines or enter non-union bus depots, Cordiello would only say, “Our members have been instructed to do nothing that’s illegal.”

His union represents nearly 9,000 drivers, matrons and mechanics — including nearly all the bus matrons who are required to supervise special-ed students.

That appeared to mean that even companies with non-Local 1181 drivers would be prevented from running their special-education routes.

Local 584 of the Teamsters union — which represents roughly 1,000 drivers, matrons and mechanics — said it wouldn’t join the strike because its contract with bus companies doesn’t allow for it.

But its president, Dan Gatto, also said his members wouldn’t cross picket lines.Parents can get updated information on which bus routes are running by clicking the Department of Education link on the city’s nyc.gov Web site or at www.opt-osfns.org/opt/Resources/SchoolRouteStSearch/searchresult.aspx.

Miami Dolphins bill would bring state money to aging stadiums

A bill drafted by the Miami Dolphins would give Florida sports teams $3 million a year in state money to improve older stadiums, provided the owner pays for at least half the cost of a major renovation.

Under the law, the stadium would need to be 20 years old and the team willing to put in at least $125 million for a $250 million renovation. That’s less than the $400 million redo of Sun Life Stadium that Dolphins owner Stephen Ross proposed this week, which he hopes will win state approval thanks to his offer to fund at least $200 million of the effort to modernize the 1987 facility.

Miami-Dade and Florida would fund the rest through a mix of county hotel taxes and state general funds set aside for stadiums. Sun Life currently receives $2 million a year through the program, and the Dolphins want to create a new category that would give them an additional $3 million.

While the Miami Marlins and Miami Heat both play in stadiums subsidized by county hotel taxes, the Dolphins receive no local dollars. The bill would change that by allowing Miami-Dade to increase the tax charged at mainland hotels to 7 percent from 6 percent, and eliminate the current rule that limits the money to publicly owned stadiums. Sun Life Stadium, in Miami Gardens, is privately owned but sits on county land.

The bill pits enthusiasm for one of Florida’s most popular sports teams against a lean budget climate and lingering backlash against the 2009 deal that had Miami and Miami-Dade borrow about $485 million to build a new ballpark for the Marlins. Ross also must navigate a Republican-led Legislature that has twice rebuffed his requests for public dollars.

“I would be surprised if that bill even got a hearing in committee,” said Mike Fasano, a Republican representative from the Tampa area and a critic of tax-funded sports deals. “I’m a big Dolphin fan, and have been for years. But with all due respect, we’ve got people who are struggling throughout this state right now . .. The last thing we should be doing is giving a professional sports team or facility additional tax dollars.”

While the bill would open up the $3 million subsidy to other the teams, the Dolphins see it as unlikely that another owner would be willing to put up as much money for renovations as Ross, a billionaire real estate developer.

If the bill were enacted today, any stadium opened before 1993 would be eligible for the money, provided it could show the proposed renovation would generate an additional $3 million in sales taxes.

Ross and his backers are pitching the renovation as a boon to tourism, with Sun Life a magnet for the Super Bowl, national college football games and other major events. The National Football League is considering South Florida and San Francisco for the 2016 Super Bowl, and the Dolphins say approval of renovation funding is crucial to winning the bid.

Sen. Oscar Braynon, D-Miami Gardens, who sponsored the Senate bill, said the funding makes sense because when Sun Life hosts a Super Bowl, the entire state benefits from both tourism dollars and publicity.

“It’s a small price to pay for economic development, and for all the shine we get from major sporting events,” said Braynon, whose district includes Sun Life. Rep. Eduardo “Eddy” Gonzalez, R-Hialeah, is the sponsor on the House side.

Wedgie-spree at Florida theater lands prankster in jail

Authorities say that Charles Ross is known to go around Manatee County and create situations in order to harass and annoy people while filming their reaction for You Tube.

Last weekend, Ross, 18, of Bradenton, ended up in jail after police say he went on a wedgie spree at a theater.

Deputies say Ross was at Royal Palm Theater Sunday night with a friend and began grabbing people by their pants and pulling them up hard, causing discomfort.

A victim told deputies that Ross pulled up his pants, wedgie-style, and then asked the victim if he wanted to hit him, all while his friend was filming, according to the Manatee County Sheriff’s Office.

One victim decided to press charges but others were too embarrassed, deputies said.

The deputy took the camera as evidence and both Ross and his friend were removed from the theater and told they would be arrested if they come back, according to the report.

SAG Awards Flashback: Daniel Day-Lewis 2003

Movie and TV stars have thousands of fans around the globe who would love to meet them, shake their hand, or even just be in the same building as them. Sometimes we forget that those very stars themselves worship other stars. As we found out at the 2003 SAG Awards, Matthew Perry has a steady admiration for Daniel-Day Lewis.

At that year's SAG Awards, Day-Lewis was nominated for his first SAG Award for Best Actor following his vivid performance in Gangs of New York. As he is being questioned by ET's former correspondent Jann Carl about fame and fandom, he is interrupted by a celebrity fan: Matthew Perry.

VIDEO: First ET Interview: Daniel Day-Lewis

The Friends actor, who is being interviewed on the other end of ET's platform, approaches Day-Lewis and shakes his hand, wishing him luck on his nomination. Perry may have been in attendance that night for his own nomination for Friends for Best Ensemble in a Comedy Series but wasn't too proud to express his adoration for a fellow actor.

"I don't know if anyone really gets used to it 'cause obviously it's not something...you...do...every day," Day-Lewis responds to the fandom question after meeting Perry. "Plus, I live it a very remote place as well. Even just going to the city for the day is shocking."

While the English actor reveals that he hasn't prepared an acceptance speech for the nomination, he would eventually have to improvise one at the podium, as he was granted his first SAG Award that night.

VIDEO: Oscars Flashback '90: Day-Lewis's Right Foot

ET catches up with Day-Lewis backstage right after he wins the award. Although his acceptance speech went well without preparation, he confesses that his heart is racing. With the Oscars following a month later, Ms. Carl informs Day-Lewis of a promising trend for him that suggests that he will also win the Best Actor Award at the Oscars.

"Is that true? Don't put a curse on it. Let's wait and see," he says. "...Quite honestly, to be amongst this group of people, if any one of them won anything we'd just stand up and applaud because it's fine, fine work."

Curse or no curse, Day-Lewis didn't receive the Best Actor award a month later at the Academy Awards. However, he did receive the Oscar five years later for There Will Be Blood, for which he had also received a SAG Award.

Five years after his last SAG-Oscar winning pair, Day-Lewis has another chance to repeat his awards season success with nominations for Lincoln for both the SAG Awards and the Oscars after recently winning a Golden Globe.

VOTE for the worst liar in history

Lance Armstrong’s lies weren’t the first to lead to a stunning crash. Here is a list of the rest of history’s 10 all-time greatest liars, a rogues gallery of devious dissemblers who can all be enshrined in the forked tongue Hall of Shame.

AFP/Getty Images

RICHARD NIXON — You know when a guy says “I am not a crook,” watch out. “Tricky Dick” Nixon took presidential perfidy to new heights, when he went on TV on August 15, 1973 and said “I had no prior knowledge of the Watergate break-in.” A year later, he resigned.

AP

BERNIE MADOFF — He was more of a Ponzi King than the scam’s inventor, Charles Ponzi. Madoff pretended to be one of the most savvy investors in New York, but his firm was a bogus house of cards that wound up costing his investors $50 billion when it collapsed. Now Bernie cooling his heels in prison.

Spencer A. Burnett

TAWANA BRAWLEY — Her lie set racial tensions in New York to boiling in the 1980s. The Dutchess County teen falsely claimed to have been abducted and raped by a group of men, including a cop and a prosecutor. In 1988, a grand jury found her story was a horrific hoax.

AP

JOHN EDWARDS — A slick haircut doesn’t mean you’re honest. The clean-cut Edwards went from possible President to loathed liar when — after two years of denials — he admitted in 2010 to siring a love child with mistress Rielle Hunter while his wife, Elizabeth, was dying of cancer.

AP

MILLI VANILLI — Their album may have been called “Girl You Know It’s True, ” but it was really a big lie. The “musical” duo of Rob Pilatus and Fab Morvan, became laughing stocks in 1990 when they had to return their Grammy for best new artist after it was revealed they did not actually sing the songs on the album.

AP

ANTHONY WEINER — Sure, you were “hacked” Mr. Weiner. When a picture of the Queens Congressman’s “member” wound up on the internet he tried to claim he got shafted — by a hacker to stole the picture and put it on line. Later it was revealed that he actually sent the pic to a young woman who was not his wife. He finally admitted “I have not been honest,” and short time later resigned.

AP

PETE ROSE — He was known as “Charlie Hustle.” It was an appropriate nickname. Baseball’s all time hit leader denied for years that he ever gambled on baseball, even though he was banned from the game in 1989. Then in 2004, he admitted he did place bets on the national passtime, and even bet on his own team, the Cincinnati Reds “every night.”

AP

MARION JONES — She lost her golds on the track, but still takes top honors for lying. The disgraced track star had the five medals she won in the 2000 Summer Olympics stripped for doping, charges she initially denied. She was later sentenced to six months in jail for lying to federal prosecutors who were probing use of steroids.

PINOCCHIO — History’s all time greatest liar, this little wooden “boy” wouldn’t know the truth if it bit him. His fibs were so devious that they actually made his nose grow, making him the forerunner of all politicians throughout history.

Global entrepreneurship nonprofit Endeavor coming to Miami

Flawless execution helped propel Argentine Marcos Galperin’s e-auction site, Mercado Libre, above the competition to become a $3.8 billion company. Some 50,000 small businesses now use it to market their wares.

Leila Velez and HeloĆsa Helena Assis, cousins who grew up in the slums of Rio, started with one product and one salon. Today their company, Beleza Natural, operates 24 salons that bring in $75 million in revenues, employs 1,500 people and has an eye on U.S expansion.

Both were powered, in part, by Endeavor, a global nonprofit that selects, mentors, supports and accelerates high-impact entrepreneurs in metropolitan areas of 16 countries — and, soon, in Miami.

Endeavor and its local supporter, the John S. and James L. Knight Foundation, announced Tuesday that Knight is providing Endeavor with $2 million in grant funding over five years for Endeavor’s first U.S. expansion. Endeavor’s Miami office could ultimately service dozens of local entrepreneurs, but first a local board needs to be assembled, a managing director hired and offices set up.

Beginning late this year, South Florida’s innovators will be able to apply to become Endeavor Entrepreneurs, connecting them to a global network of mentors and advisors who can help grow their ventures. “We think this is a cornerstone of making Miami more of a place where ideas are built,” said Matt Haggman, Miami program director for the Knight Foundation, which has made entrepreneurship a key focus of its Miami program.

The announcement is an important milestone in Miami’s efforts to accelerate an entrepreneurial ecosystem, which has been gaining momentum, said Haggman, who led the effort for Knight, its largest investment in entrepreneurship to date. Accelerators, incubators and co-working spaces have been opening up, including Launch Pad Tech, which is receiving $1.5 million in public funding and opens for its first class next week. Last month, the first ever Innovate MIA week attracted hundreds of entrepreneurs, investors and other supporters to a packed schedule of daily events, which included the Americas Venture Capital Conference and Endeavor’s International Selection Panel.

“Miami is almost the perfect seeding ground for Endeavor,” said Peter Kellner, co-founder of Endeavor and now an Endeavor board member, an investor and South Florida resident who began discussing the project with Haggman in the spring. “There are commitments from large institutions like Knight, FIU, UM, there is capital, there are people that are interested in making things happen, there are already clusters of activity like accelerators and incubators. That’s where Endeavor thrives.”

Endeavor selects and works primarily with companies from a wide range of industries that are already earning $500,000 to $15 million in annual revenue and ready for the next stage: explosive growth.

“While the vast majority of small businesses employ two or three people, Endeavor businesses employ an average of 237,” said Endeavor co-founder and CEO Linda Rottenberg.

Launched in 1998 and headquartered in New York City, Endeavor now operates throughout Latin America, Africa, the Middle East, Europe and Southeast Asia and supports more than 750 entrepreneurs who are chosen in a rigorous selection process.

Veteran Keys deputy being ousted from city-owned home meant for low-level officer

Monroe County Sheriff Office Sgt. Jake Brady is officially on the lookout for new digs — but he'll have a hard time matching the sweetheart deal he's had with the city of Marathon since 2002.

The longtime Keys cop and Republican candidate for sheriff last year was given 90 days notice to vacate the city-owned three-bedroom house at Sombrero Beach in which he has been living for 10 years, according to Marathon City Attorney John Herin.

"We provided notice to the current occupant to give him 90 days," Herin said.

The council agreed in 2003 to rent the house to a low-tenure Sheriff's Office deputy for $500 per month. Brady has been living at the beach since and the original lease expired in August 2004.

Herin went so far as to ask the council for "authorization to do eviction procedures" in the event Brady doesn't move out on time. He was clear the request is precautionary but noted that Brady has "consistently been late with his monthly payment."

City Manager Roger Hernstadt said the house is the only one owned by the city intended for Sheriff's Office deputies. He said Brady's arrangement came to his attention during an end-of-year review of contracts and properties.

"That's when it came to my attention that he'd been there a long time and we didn't have a current lease," Hernstadt said. "It's been roughly 10 years and we haven't been in it and we want to be sure ... that whatever it takes to maintain the property happens."

Once Brady moves out and the house is cleaned, another deputy — on the lower end of the pay scale — will likely move in.

WB InStyle Golden Globes Party: Stars React to Jodie Foster's Speech

Awards acceptance speeches provide actors with not only a medium to thank those who helped them receive the award but also a platform to make their voice heard, which Jodie Foster did at Sunday night's Golden Globes. Stars reacted to Foster's acceptance speech at the WB/ InStyle party after the show.

While accepting a lifetime achievement award at the Globes, Foster digressed into her personal life, emotionally delving into her love life and sexuality. The speech captured the room and found many in the audience in tears.

"Jodie Foster's speech made me cry. It was so beautiful," said Nashville star Connie Britton. "...She's just such an example for all of us. She's done such amazing work as a woman in film and I admire her on every level."

Also touched by the heartfelt speech were Spring Breakers actresses Vanessa Hudgens and Selena Gomez, who marveled at her courage in delivering the speech. Gomez labeled it as one of her favorite awards speeches of all-time.

"It was absolutely incredible. I think it was probably one of my favorite speeches and I've watched [the Golden Globes] since I was ten years old with my mom," the 20-year-old actress and signer said. "I think it was beautiful [and] well-said."

While most had an emotional response to the speech, Modern Family actress Sofia Vergara had a different response to the speech. As she maintains, the awards season is all about celebration, not emotion.

"I didn't cry. For me, these awards [are] not about crying," she said. "For me, it's about how amazing [everything is] and celebrating. I mean, it's not like we're working on a mine in Peru. It's just fun and beautiful things."

Woman at center of Berlusconi trial in court

MILAN — The Moroccan woman at the center of former Premier Silvio Berlusconi's sex-for-hire trial was in court Monday to testify as a witness for the first time while defense lawyers sought to shut down the trial because of Italy's election campaign.

Karima el-Mahroug was ordered by the court to appear after failing to show on two previous dates, reportedly because she was in Mexico on vacation. She has been called as a defense witness.

Berlusconi is accused of paying for sex with el-Mahroug, better known as Ruby, when she was 17, and then trying to cover it up. Both deny sexual contact.

REUTERS

Karima El Mahroug, better known by her stage name "Ruby the Heartstealer", smiles as she arrives at Milan's court Monday.

El-Mahroug is the last witness due to testify, meaning that a verdict could come before the Feb. 24-25 elections in which Berlusconi is heading a center-right coalition.

But Berlusconi's defense lawyer, Niccolo Ghedini, filed a motion to suspend the proceeding, citing the demands of the election campaign.

The prosecution opposed the request, arguing that Berlusconi is not the formal head of his party and that he has infrequently shown up for trail anyway, as is his right.

The judges were deliberating. A decision on the motion was expected later Monday.

El-Mahroug looked relaxed, chatting with her lawyer. She wore a dark parka with fur trim and carried a fashionable Louis Vuitton handbag.

Miami Dolphins worry Marlins stand between them and a tax-funded redo for Sun Life Stadium

The Miami Dolphins are reviving their failed bid to win tax dollars for a football stadium. But team executives want no comparisons to a successful bid to win tax dollars for a baseball stadium.

Dolphins owner Stephen Ross has called a press conference for Monday to unveil a plan for an improved Sun Life Stadium. Sources say the plan will include asking state and local governments to help pay for a $400 million renovation of the 1987 facility.

State lawmakers in recent years rebuffed the Dolphins when the team asked for help on a less-expensive renovation. And while the economy and state finances are more favorable this time around, Dolphin executives see a bigger challenge now from lingering backlash against the $639 million ballpark taxpayers built for the Miami Marlins in order to move the baseball team from their old home in Sun Life. .

“It can’t be anything close to what the Marlins did,’’ said state Sen. Oscar Braynon, a Democrat whose Miami Gardens district includes Sun Life Stadium and who sponsored a 2011 bill to raise hotel taxes to fund the Dolphins renovation plan. “Unless you do something totally counter to what the Marlins did, nobody is going to vote for it.”

Both the Marlins and the Dolphins declined to comment for this story. The Dolphins have not released details of how they want to pay for the renovation, or what they want to do the stadium. But sources close to the team describe an extensive renovation of Sun Life, including adding a partial roof, a redesign of the seating configuration to improve views of the field, and shifting capacity from the low-priced seats in the upper deck to the more expensive seating closer to the sidelines. Without the space demands of a baseball field, the front row will move 18 feet closer to the field, according to a person briefed on the plans.

Polls showed Miami and Miami-Dade’s 2009 votes to build the baseball stadium with 75 percent public money were never popular. But the Marlins’ recent stripping of star players from their payroll has made the new Little Havana park Topic A when it comes to plotting a Dolphins’ victory for winning tax dollars themselves.

Dolphins executives plan to pursue two funding sources from state and local government, according to several people familiar with the team’s plans. For the first funding stream, the Dolphins plan to ask Miami-Dade to raise taxes charged mainland hotels from 6 percent to 7 percent and earmark the extra money for the stadium. The Dolphins also plan to ask Florida for an additional $2 million rebate on sales taxes on top of the $2 million the stadium already receives from the state each year under a special subsidy for professional sports teams.

Ross is expected to pledge a significant amount of the renovation money himself. Sources who have been briefed on the Dolphins’ proposal say the total pricetag for the project is $400 million. That’s almost double the renovation budget the Dolphins proposed when the team last went to the Legislature for money in 2011.

Staying competitive

At the time, the Dolphins unveiled a $225 million redo of Sun Life with expanded sideline seating, high-definition lighting and a partial roof that would both shade seats during hot games and shield spectators from the kind of downpour that drenched the stands during the 2007 Super Bowl in Miami Gardens. The Dolphins, top executives at the NFL and some community leaders have warned that without upgrades to Sun Life, South Florida risks losing its standing as one of the nation’s top venues for the Super Bowl and college football championships.

Newark mayor to headline Broward Democrats’ fundraiser

Rising Democratic star and Newark, N.J. Mayor Cory Booker will be the keynote speaker at the Broward Democrats’ annual fundraiser March 23.

“He is clearly part of next generation of Democratic leaders,” local party chairman Mitch Ceasar said.

Booker, an African-American Rhodes scholar and Yale University law grad, became mayor at age 37 in 2006. He turned down a job offer from President Barack Obama after his first win. In 2012, Booker spoke at the Democratic National Convention and recently confirmed he is exploring running for U.S. Senate.

The Unity Dinner is the main fundraiser for Broward Democrats, who are preparing for the 2014 elections — most notably, a challenge to Gov. Rick Scott.

Facebook tests $100 charge to message Zuckerberg

NEW YORK (AP) — Would you pay $ 100 to message Mark Zuckerberg? Facebook says it’s testing some “extreme price points” to let users pay to have their messages seen by people who are not their friends.

The tech blog Mashable reported early Friday that some users trying to message Zuckerberg are offered the option to pay $ 100 to ensure that their missive reaches the Facebook CEO’s inbox. Without paying, the message would likely end up in Zuckerberg’s “other” message folder, an oft-overlooked purgatory between the spam folder and the inbox.

Facebook says it’s testing the “extreme” prices to “see what works to filter spam. The company is also testing a service that lets people pay $ 1 per message to route communications to non-friends’ inboxes.

Zuckerberg has more than 16 million followers on the site.

6 arrested in new gang rape of bus passenger in India

Indian police personnel present six arrested men, accused of a gang rape in Punjab state, for an appearance at court in Gurdaspur.

NEW DELHI — Police said Sunday they have arrested six suspects in another gang rape of a bus passenger in India, four weeks after a brutal attack on a student on a moving bus in the capital outraged Indians and led to calls for tougher rape laws.

Police officer Raj Jeet Singh said a 29-year-old woman was the only passenger on a bus as she was traveling to her village in northern Punjab state on Friday night. The driver refused to stop at her village despite her repeated pleas and drove her to a desolate location, he said.

There, the driver and the conductor took her to a building where they were joined by five friends and took turns raping her throughout the night, Singh said.

The driver dropped the woman off at her village early Saturday, he said.

Singh said police arrested six suspects on Saturday and were searching for another.

Gurmej Singh, deputy superintendent of police, said all six admitted involvement in the rape. He said the victim was recovering at home.

Also on Saturday, police arrested a 32-year-old man for allegedly raping and killing a 9-year-old girl two weeks ago in Ahmednagar district in western India, the Press Trust of India news agency reported. Her decomposed body was found Friday.

Police officer Sunita Thakare said the suspect committed the crime seven months after his release from prison after serving nine years for raping and murdering a girl in 2003, PTI reported Sunday.

The deadly rape of a 23-year-old student on a New Delhi bus in December led to the woman's death and set off an impassioned debate about what India needs to do to prevent such tragedies. Protesters and politicians have called for tougher rape laws, police reforms and a transformation in the way the country treats women.

"It's a very deep malaise. This aspect of gender justice hasn't been dealt with in our nation-building task," Seema Mustafa, a writer on social issues who heads the Center for Policy Analysis think tank, said Sunday.

"Police haven't dealt with the issue severely in the past. The message that goes out is that the punishment doesn't match the crime. Criminals think they can get away it," she said.

In her first published comments, the mother of the deceased student in the New Delhi attack said Sunday that all six suspects in that case, including one believed to be a juvenile, deserve to die.

She was quoted by The Times of India newspaper as saying that her daughter, who died from massive internal injuries two weeks after the attack, told her that the youngest suspect had participated in the most brutal aspects of the rape.

Five men have been charged with the physiotherapy student's rape and murder and face a possible death penalty if convicted. The sixth suspect, who says he is 17 years old, is likely to be tried in a juvenile court if medical tests confirm he is a minor. His maximum sentence would be three years in a reform facility.

"Now the only thing that will satisfy us is to see them punished. For what they did to her, they deserve to die," the newspaper quoted the mother as saying.

Some activists have demanded a change in Indian laws so that juveniles committing heinous crimes can face the death penalty.

The names of the victim of the Dec. 16 attack and her family have not been released.

After rough year, Carnival hopes for calmer waters

After boarding the latest addition to the Carnival Cruise Lines family, Josh Beaver sampled lasagna at the new onboard Italian restaurant, downed some drinks with his traveling companions and hit the water slides while the afternoon was still young.

“So far, from what I’ve seen, there’s lots to do,” said Beaver, 33, of Holden Beach, N.C.

The Carnival Breeze hadn’t even left PortMiami yet on a recent Saturday, and already it buzzed with vacationers exploring all there was to do: nosh on a Pig Patty from the new Guy’s Burger Bar, make friends with bartenders at the new RedFrog Pub or check out a novel and a glass of the grape at the new Library Bar.

Here aboard one of the largest ships in the biggest brand of the Number One cruise ship company in the world, there was little hint that the last year was one of the toughest in the 41-year history of parent company Carnival Corp. & plc.

Last year got off to a catastrophic start when Costa Concordia, owned by Carnival unit Costa Cruises, struck rocks in Italian waters as the captain steered the ship on an unauthorized route. The massive liner listed to one side, and 32 people died in the chaos that followed.

“When you lose lives, it’s heartbreaking,” said Carnival Corp. Vice Chairman and COO Howard Frank, who devoted much of his time last winter handling the aftermath with Costa leaders. “And so I think in terms of our emotional reaction to it, it’s been the toughest year we’ve had.”

Carnival Corp. Chairman and CEO Micky Arison took criticism for not going to Italy following the wreck, but said he believes the company did the right thing and doesn’t second-guess his actions.

Financially, the company took a hit as well, starting with discounts that were necessary to drum up business after the accident. Costa’s future bookings plunged, but picked up after the operator slashed prices. As of mid-December, prices at Costa remained lower than they were a year earlier, though the company expects that to change once the anniversary of the accident passes.

“I think we’ve been consistent in saying the recovery at Costa is not a one-year issue,” Arison said during the December earnings call with analysts. “It’s going to be multiple years, and we are forecasting a recovery of about half the yield deterioration.”

The ship remains on its side off the island of Giglio; it’s expected to be removed by the end of summer.

A flurry of civil lawsuits have been filed, but none have reached trial yet; the company has reached compensation agreements with 70 percent of the more than 3,000 passengers who were not physically injured and 60 percent of injured passengers and families of those who died.

As the company and broader industry focused anew on safety, the summer months presented a fresh set of problems when the European economy weakened just as cruise lines were stationing more ships in the Mediterranean. While North America was immune to those concerns, the run-up to the Presidential election and the fiscal cliff debates prompted Carnival to worry about a slowdown in business at home.

Last month, Carnival forecast 2013 earnings that were lower than expectations and said advance bookings for the year were behind what they were a year earlier at lower prices. Many analysts believe the projections were conservative, though, and executives said they were hopeful that January would bring more robust business.
